Register of Trademarks
The purpose of the Register of Trademarks is the legal protection of the name of your product or service to prevent the use by third parties.
Trademarks can be word marks (words, letters or numbers), pictorial marks (drawings, logos) or mixed marks (combines names and figurative elements).
The trademark provides the owner the exclusive use of it, with the ability to exclude others in the use of that trademark and any other that may cause confusion or in any way affect the exclusive right.
As a result of property rights, the owner can make decisions as regards the trademark by sale, cession, franchising or license.
The trademark registration is a process that must be done in each country in which you have interest in protecting it.
The International Classification (The Classes)
There are 45 classes comprising all existing products and services. 1-34 classes comprise products, and classes 35-45 comprise services.
The trademark registration protects the brand in the country in which the registration is made. The Classification is International because it is an agreement between the nations of the world that was established under the Nice Agreement in 1957 and it is constantly reviewed by the Committee of Experts of the Nice Union.
The protection of a trademark is for products or services that are included within each class.
That is, if I register a trademark in Class 25 (clothing), I will have the exclusive use of the trademark in all clothing, but I will not be able to object if there is a cigarette box (Class 34) with a similar or same trademark. The way to avoid such use is registering the trademark in that class too.
There are products or services that by their peculiarities it registration is suggested in some extra class in addition to the specific class. For example, if you have a trademark of soft drink you should select Class 32, but also we suggested to register in Class 33 (alcoholic beverages) even when you have no intentions of selling alcoholic beverages but in order to prevent third parties to use (or exploit) your trademark to sell those products.
The coverage of your trademark will depend on number of classes that you protected them.
The Comprehensive Study of a Trademark:
You can choose to make the registration of your trademark with prior Comprehensive Study, or directly apply for registration.
The Comprehensive Study is to conduct a search in the database Trademark Office of a country to check for identical or similar existence of registered trademarks and your brand.
In case you request the Comprehensive Study we will send you a report with analysis and a legal opinion on the convenience of requesting the trademark registration and suggesting the classes to properly protect your trademark. This report is optional but is highly recommended.
The Comprehensive Study is useful to be able to determine or at least evaluate the feasibility or probability that your trademark application will be admitted.
The Comprehensive Study does not guarantee success on the registration process and on the other hand the existences of similar trademarks registered not imply impossibility of carrying out the process successfully, it is recommended to evaluate the situation.
Passed that stage, the process of trademark registration can start.
Trademark Registration Request:
The application for trademark registration is the process that occurs in the Trademark Office of the Country chosen and that start the registration process.
The Trademark Registration Request includes starting and the whole process tracking.
From GLOBEMARKED we will inform you all events that occur during the process and if any oppositions or objections to the registration are presented by third parties.
The presentation of the procedure does not imply acceptance or granting of the trademark applied for, but the process must go through the relevant stages until obtain its final resolution and the corresponding registration certificate.
Passed the initial stage of the procedure, the trademark applied is published in the respective Trademark Bulletin giving a period to third parties to raise opposition.
Once the Trademark Office issued the resolution to grant the request, GLOBEMARKED will communicate you that news.
Registration Certificate:
The Registration Certificate is the document issued by the Trademark Office of each Country that certifies the ownership of a trademark.
