This Agreement of Terms and Conditions lays down the rules of use for the website www.globemarked.com.ar.
Definitions used in this Agreement of Terms and Conditions of Use:
USER: People who enter and use the website www.globemarked.com.ar or any of its related sites, regardless of whether they are registered on the website. It is also understood USER as the owner or representative of the owner requesting the services provided by GLOBEMARKED. The representative is understood that is expressly authorized by the owner to provide GLOBEMARKED of the required information and application services on its behalf.
WEBSITE: The website www.GlobeMarked.com.ar in which services are offered.
GLOBEMARKED: Is a WEBSITE which address is Independencia 468 6 B, Córdoba, Córdoba, Argentina.
CORRESPONDENTS: They are the professionals responsible for implementation of the assignment process and through which GLOBEMARKED serves.
Users should carefully read and review this agreement before making use of the website and the services offered by GLOBEMARKED. The use of the website and the services offered by the user implies acceptance of the content of this agreement terms and conditions. If the user does not accept this agreement of terms and conditions of use, you must not access the website or any of the related sites or use the services offered by GLOBEMARKED.
I. Preliminary considerations
The use of the WEBSITE by the users and their rights are governed by these Agreement of Terms and Conditions of use, the Professional Service Agreement and Privacy Policy. The user should take the time to review the legal texts carefully before using the WEBSITE.
By using the WEBSITE in any way, the user undertakes to comply with these Terms and Conditions of Use Agreement, the Professional Service and Privacy Policy of GLOBEMARKED and is presumed that the user has read and accepted all the legal framework, the Terms and Conditions of Use Agreement, the Professional Service and Privacy Policy.
GLOBEMARKED reserves the right to change the Terms and Conditions of Use Agreement, the Professional Service and Privacy Policy at any time for any reason without prior or subsequent notice.
The updated versions of the Terms and Conditions of Use Agreement, the Professional Service and Privacy Policy will be posted on the website. The User is obliged to visit and review the Terms and Conditions of Use Agreement, the Professional Service and Privacy Policy regularly to keep informed of any changes.
Continued use of the WEBSITE by the User after implementing any changes or modifications to the Terms and Conditions of Use Agreement, the Professional Service and Privacy Policy means that the USER accept and agree any modification introduced in the Terms and conditions, the Professional Service Agreement and Privacy Policy.
GLOBEMARKED reserves the right to modify or discontinue, temporarily or permanently, the WEBSITE, any of its features, benefits, promotions, rules or conditions, all without notice, even though these changes may affect the way which the USER makes use of the WEBSITE. You agree that GLOBEMARKED shall not be liable to you or any third party for any modification or discontinuance of the WEBSITE.
The USER accepts and declares to comply with all applicable laws, statutes, regulations and ordinances regarding the use of the WEBSITE.
All the material on the WEBSITE is protected by the laws governing copyright, trademarks and other intellectual property rights. The material on this website may not be copied, reproduced, published, transmitted or distributed in any way by the USER and / or third parties without authorization GLOBEMARKED.
II. General Rules
GLOBEMARKED is only responsible for providing the services for which has been hired by the WEBSITE, which include services that are contracted directly to GLOBEMARKED or its CORRESPONDENTS.
The information, services and products offered by the WEBSITE may contain errors and are subject to changes or interruptions. The WEBSITE is not responsible for any errors, defects, lost profits or other damages caused by the use of the WEBSITE.
GLOBEMARKED aims to provide services of trademark registrations in the greatest possible number of countries around the world through the WEBSITE striving to achieve the most competitive market prices.
GLOBEMARKED has the duty to comply with the service once the USER paid, but it has no responsibility for the form or timing with which these services are provided.
The USER that use the services of the WEBSITE accepts this agreement and expressly disclaims any compensation claim or right it may have against GLOBEMARKED.
GLOBEMARKED expressly disclaims any guarantee that its services will be error-free. The oral advice or written or verbal information provided by GLOBEMARKED or its CORRESPONDENTS, agents or employees, will not generate a guarantee, nor may it be used by the USER as a basis for further action.
It is understood that the WEBSITE is not likely to cause damage or injury to the USER and the use of the services of the WEBSITE does not guarantee to the USER the success but the realization of the process.
GLOBERMARKED and/ or its CORRESPONDENTS under no circumstances will be liable for any direct, indirect or possible damage resulting from the use or inability to use the services of the WEBSITE.
GLOBEMARKED reserves the right, without explanation, to reject any request for service. Any new service request ordered directly to GLOBEMARKED or its dependents without using the WEBSITE is subject to this agreement of Terms and Conditions, the Professional Service Agreement and Privacy Policy.
GLOBEMARKED and its CORRESPONDENTS not assume any responsibility in the event that a Trademark, entrusted management or whatever service contracted, do not obtain the desired result or not settled favorably.
The USER agree that any objection, opposition or rejection, or any situation that impedes continue with the processing of an application for trademark registration, are not the responsibility of GLOBEMARKED or its CORRESPONDENTS renouncing the USER to any compensation of any kind.
All the formalities made by GLOBEMARKED and its CORRESPONDENTS will be conducted according to the information provided by the USER. In that order, the USER while gives information about the owners and the rights to be protected stated in an affidavit that such information is true, that it belongs and does not violate rights of others. Also in the event that such information or management is entrusted by the USER on behalf of a third party, the USER affirm that has authorization to apply for the service.
Also GLOBEMARKED and its CORRESPONDENTS will not be liable if the information provided violates third party rights or contains errors or omissions, being the user responsible for the data delivered to GLOBEMARKED on its WEBSITE or any alternative means of contact.
The Trademark Watch Service and Trademark Comprehensive Studies may contain errors or omissions arising from the information available in the data banks. The USER renounces to make any claim or compensation against GLOBEMARKED or its CORRESPONDENTS for errors or omissions in the information provided and frees them from responsibility.
Under no circumstances GLOBEMARKED will be liable for damages incurred to the USER because of their connection to the WEBSITE or caused for breakdown in communications or malfunction of servers of GLOBEMARKED.
The WEBSITE provides USERS a personal account. The creation of it is by the will of USER and implies acceptance and consent of the Terms and Conditions of Use Agreement, the Professional Service and Privacy Policy WEB SITE.
The USER can create a personal account that will access indicating "User Name" and password. The USER is responsible for the custody and confidentiality of the password and the way the WEBSITE is used. Creating a personal account is necessary for the provision of services offered on the WEBSITE requirement. The USER is responsible for maintaining the confidentiality of the information, including the password and for all activities that occur under the user account.
GLOBERMAKED provides the USER the possibility to access to personal account even when USER has forgotten it "User Name" or password, notifying it (prior user's request) to the email account that the user has supplied GLOBEMARKED.
The USER agree to provide accurate, current and complete information about their data as required in the registration process.
The USER agree to notify GLOBEMARKED immediately of any unauthorized use of their personal account or password, or any other violation of security. It is forbidden for the USER using the password or account of another person, and trying to access to another USER's account, it constitutes an impermissible violation. In case GLOBEMARKED detect such attempts by any USER, or that help others in such attempts or provide instructions, software or tools for that purpose, the USER’s account will be canceled, however the actions of responsibility GLOBEMARKED may exercise against she/he or it.
GLOBEMARKED has the right to terminate the access to any USER personal account for any reason, if there is a presumption or reason to believe that USER have infringed these Terms and Conditions of Use Agreement, the Professional Service and/or the Privacy Policy or that the USER took any other conduct that violates the principles and rules of good faith. The USER renounces to claim any compensation for such cancellation.
GLOBEMARKED will not refund the amounts paid in case of errors or omissions made by the USER, including if USER broke any rule of the Terms and Conditions of Use, and/or the Contract of Professional Service and/or the Privacy Policy of the WEBSITE, or for any delay or error in the information or documentation provided by the USER that it is necessary to carry out a procedure.
The USER may request within 30 days of payment, the drawback of the payment always that the process has not started. Such withdrawal will be total and without deductions if the request for money back is made within 72 hours of payment, otherwise it will be deducted 5% of the total paid as administrative expenses.
After 30 days the payment is done and if the processing ordered has not been started by lack of information or documentation that must be provided by the USER to GLOBEMARKED, only official charges or rates will be given back.
Once the payment is done and service is contracted by the USER through the WEBSITE, the USER agrees that GLOBEMARKED will start the process without delay and with the information and documentation provided by the USER. The process will not start if the documents or information provided by the USER is insufficient.
The USER is responsible for providing GLOBEMARKED, within the terms sets, all the information and documentation that is required. That applies both for the start of the process as in the case of objections, oppositions or rejections occur during the process. The USER acknowledge and agree that the deadlines are fatal and if there are not complied the right of action is lost, which usually leads to loss of registration.
The USER accept and agree to provide full cooperation, complete and timely providing with accuracy all the information required by GLOBEMARKED.
The USER agrees that the decision of not continue with the process in case of objections, oppositions and/or rejections occur during the process of trademark registration, within the time required by GLOBEMARKED, is presumed that the USER is not interested in continue the process, assuming that the USER hasn´t any right to claim the money back under any circumstances.
The USER declares that it is the unique responsible for any claims, proceedings, damages, injuries, losses or costs that may cause their actions or in connection with applications or services contracted through the WEBSITE, releasing completely to GLOBEMARKED or its CORRESPONDENTS from all responsibility. The USER agrees to indemnify if any claim of a third party in relation to the trademark or services contracted through the WEBSITE involves GLOBEMARKED.
Every communication between the USER and GLOBEMARKED will be via e-mail, addressed to the provided e-mail. The USER agrees to provide a valid e-mail address and is he/she or it responsibility to inform GLOBEMARKED for any changes, assuming that all notifications or communications sent by GLOBEMARKED to the USER shall be deemed received and notified by the mere fact of being sent. The USER agrees to enter to his/her or it e-mail account periodically and check emails sent by GLOBEMARKED assuming that not reading an e-mail can imply the loss of rights by the expiration of fatal deadlines.
Any request or requirement that a USER or third party want to formulate in defense of their rights, expressly agree and accept the competence of the Ordinary Court of the City of Córdoba, Argentina.
